The decision came as a surprise since Malawi's child welfare minister came out Thursday in support of the singer's application to adopt 3-year-old Chifundo "Mercy" James.
Madonna was not present in the courtroom for the ruling, and there was no immediate comment from her spokeswoman in New York. The pop star's lawyer filed notice he would appeal, but no hearing date was set.Malawian lawyer for Madonna, Allan Chinula has confirmed logging a notice of appeal.
"I have filed the notice of appeal on instructions from my client," Chinula confirmed.
Madonna is also apparently throwing a party in Malawi in a bid to swallow her disappointment that a judge rejected her application to adopt a young orphan.
Traditional dancers have arrived at the luxury lodge where the pop diva is staying, as well as government officials and members of staff of her Raising Malawi charity.
Amid strict security, there was no immediate confirmation on whether it was a farewell party.
